Who: Mccabe & Company Ltd

What: Intellectual Property legal services

NZ HQ: Wellington and Auckland

Who do you work with and what key challenges do you help them solve?

We help startups, individuals, and small to large companies in New Zealand and abroad protect and generate revenue from their intellectual property. Our core activities include registering trade marks, patents, and designs, along with providing strategic advice on what to protect and where.

We work with our sister patent attorney firm, McCabe & Company, to provide a complete IP service.

Once IP is identified and strongly protected, we assist with negotiating licensing deals, including franchises, to secure revenue streams from royalties and other payments.

We can also conduct IP audits for businesses and support the sale or transfer of IP assets.

Key services and resources

  1. IP Strategy – What IP do you need to run your business successfully? What do you currently have, and what’s missing or could strengthen your position? What future-proofing do you require?
  2. Identifying Assets – Assessing methods of protection, often starting with a free 30-minute initial call.
  3. Patents – Drafting patent specifications to protect inventions; filing for patent protection in relevant markets; managing a portfolio of patents; and staying current with your tech team to identify improvements and new inventions.
  4. Branding – Developing branding strategies to cover all of your products (goods and services); protecting brands by registering trade marks in relevant markets; managing your trade mark portfolio to ensure brands remain current and protected; and preserving your reputation in the market.
  5. Copyright – Advising on copyright matters, including authors’, musicians’, filmmakers’, and sculptors’ rights.
  6. Trade Secrets – Are your trade secrets really secret? Advising on protecting your proprietary processes and methods.
  7. Enforcement – Monitoring markets for infringing uses; advising on infringements of your IP rights; suing infringers in court; and defending any IP-related actions brought against you.

What excites you about the work you do?

We get to meet people who are inventing exciting new things, developing innovative products, and expanding into new markets. Our clients are typically forward-thinking, commercially minded, and helping to build a more successful, vibrant New Zealand.

We also act for overseas companies seeking protection for new technologies and products they are bringing into NZ.

What recent news and highlights can you share about your work and impact?

  • We’ve recently helped a major NZ wine company with trade mark clearance (“freedom to operate”) work, ensuring they could safely launch a major new brand in key overseas markets.
  • We successfully stopped Chinese drop-shippers from importing a product that infringed a NZ client’s well-known trade mark for its agricultural product.
  • We successfully stopped the copyright infringement of a client’s industrial product that was damaging their reputation and undercutting profits by flooding the market with inferior products.
  • We sponsor the annual NZ Biotech Conference in Wellington and work with clients to protect advanced biotech inventions.
  • For more than 65 years, we’ve been proud to provide succinct, practical, and commercially focused advice to clients on IP matters. We’re proud to have worked with thousands of businesses from NZ and abroad in protecting, managing, and defending their IP rights.
