If your startup uses AI to create content, product ideas or business documents, do you know who owns what your team produces?

In most cases, work generated solely by AI cannot be protected, because copyright requires a human author. That means the blog post, image or code your team relied on AI to create may not belong to anyone, leaving it open for competitors to copy.

Copyright is only part of the picture. Your brand name, logo, product designs and confidential ideas are protected in different ways, through trade marks, registered designs and good confidentiality practices, and AI changes the risks around each. It can help your team move faster, but it can also reproduce someone else’s protected work, or expose your own ideas if private information is inadvertently entered into a tool.

The goal is not to avoid AI. It is about knowing what you own across all your IP, protecting it early, and checking AI output before it goes out the door.

5 Practical Tips for Protecting IP in the Age of AI

  1. Know what you own: Identify the content, images, code, designs, brand names and business ideas that matter most to your startup, and remember that material made entirely by AI usually cannot be protected by copyright.
  2. Protect your brand early: Register important trade marks and designs so it is harder for others to copy or profit from your name, logo or product look.
  3. Keep private information private: Do not put confidential ideas, customer data or business plans into AI tools unless you understand how they store and use that information.
  4. Check AI output before you publish: Review AI-generated content to confirm it is accurate, suitable, and not reproducing someone else’s protected work.
  5. Set clear AI rules: Give your team simple rules on which AI tools they can use, what information is off-limits, what human input is required, and who signs off before anything is published.
